Terms and conditions for reviews published on our website
1. Pranarom France, a company registered with the Lille Trade and Companies Register under number 39867170100058, whose registered office is located at 253 Boulevard des Leeds - 59 777 Lille, intra-community VAT number FR71398671701 (hereinafter "Pranarom"), operates the website available at https://herbalgem.fr/ (hereinafter the "Site").

2. HerbalGem offers individual consumer users of the Site (hereinafter "Users") the opportunity to give their opinions on the product(s) offered on the Site (hereinafter "Reviews"). Reviews are the expression of the User's personal opinion on their consumption experience through any qualitative or quantitative assessment, provided that they have purchased the product for which they are submitting their Review on the Site, in a pharmacy, or in a store.
3. The purpose of these general conditions on Reviews published on the Site (hereinafter "General Review Conditions") is to define the conditions under which User Reviews are collected, read, validated, published on the Site, and moderated by Pranarōm.
4. The communication of a Review by a User to HerbalGem implies that Users fully and completely accept the General Review Conditions by checking the box provided for this purpose before being able to send their Review to HerbalGem. By leaving a Review, the User therefore unreservedly accepts the provisions of the General Review Conditions and undertakes to comply with them. The User acknowledges being fully informed of the methods of collecting and processing Reviews by HerbalGem.
HerbalGem is free to modify the General Review Conditions at any time and without prior notice, in particular to take into account any legal, jurisprudential and/or technical developments. The version of the General Review Conditions that prevails is the latest version available on the Site. Users acknowledge and accept that by using the Site and making purchases through it, they must also comply with HerbalGem's general terms and conditions of sale (hereinafter the "GTC") which apply concurrently with the General Review Conditions.
5. The User accepts that the first name entered when submitting the review or their initials will be associated with their Review. Furthermore, the User understands that the email address entered when submitting their review may be used by HerbalGem to contact them about the Review.
Users wishing to leave a Review on the Site must:
– go to the section on the product sheet of the product concerned that they have purchased or used,
– Assign a rating to the product concerned, from 1 (one) to 5 (five) stars according to their level of satisfaction by clicking on the corresponding number of stars,
– Fill in their Review in the box provided for this purpose by entering a title and a comment. The submission of one or more photos is also accepted.
– After having read, understood and accepted the General Review Conditions, check the box provided for this purpose,
– Give their express consent to the sharing of this Review by checking the consent box provided for this purpose, then validate the sharing of this Review by clicking on "Submit my review",
The provision of this information is a condition for HerbalGem to take the Review into account. HerbalGem will verify the Review and publish it or not. It is understood that the User is free to leave a Review or not and receives no consideration in exchange.
6. The User understands and accepts that HerbalGem monitors Reviews before publishing them on the Site. The monitoring implemented consists of checking that the Reviews submitted comply with the conditions listed below:
– The content of the Review refers exclusively to the product concerned by the evaluation
– The Review submitted is motivated by explanations concerning the product
– The Review submitted does not contain personal data or messages
– The Review submitted does not contain links to other content or web pages
HerbalGem reserves the right not to publish Reviews that do not comply with the General Review Conditions.
The User expressly accepts that they may not, in particular, publish Reviews:
– Infringing copyrights, patents, trademarks, designs and models, and more broadly intellectual property rights, manufacturing secrets, trade names and/or the privacy of third parties;
– Defamatory, insulting, denigrating and/or slanderous, and in general Reviews exceeding the permissible limits of simple objective criticism of the product concerned;
– Discriminatory and/or inciting violence or racial, religious or ethnic hatred, or xenophobia or anti-Semitism;
– Obscene, pornographic and/or paedophile, contrary to public order or morality, or whose object or cause would be illegal;
– Likely to be qualified as misappropriation, fraud, breach of trust or to fall under the scope of any other criminal offense;
– Likely to damage any computer system or to clandestinely intercept any data or information;
– Containing hypertext links, URLs, personal data (telephone number, postal or electronic address, credit card number etc.) and/or confidential information;
– Manifestly erroneous or illegible (blank Review, error on the product concerned, Review in a foreign language, duplicate etc.);
– Not originating from a User of the product concerned (spam, advertising communications or from a professional);
– Likely to harm the image and/or reputation of HerbalGem or its suppliers and/or to constitute acts of unfair competition or parasitism against HerbalGem and third parties;
– Aimed at diverting or attempting to divert all or part of the Users of the Site or to incite all or part of the Users not to or no longer buy products on the Site.
In addition, a Review from a User responsible for misuse of the product or who has not followed the instructions for use will not be published.
Furthermore, if the User wishes to share feedback relating to product selection, prices, composition, ordering, delivery, formats or more broadly their relationship with HerbalGem, they must contact HerbalGem's customer service directly at contact-fr@inula.com and not leave a Review on this subject, which will be rejected by HerbalGem's Review moderation team.
7. The User understands and accepts that they are solely responsible for the Reviews they publish on the Site. Consequently, HerbalGem cannot be held liable towards third parties for Reviews published on the Site, unless otherwise provided by law.
8. Given the moderation system in place, the publication time of a Review can vary from a few hours to several days. However, it is understood that the maximum publication time for a Review is fifteen (15) days.
9. As part of the moderation system, HerbalGem can either: (i) Decide not to publish the Review contrary to the terms of the General Review Conditions; or (ii) Publish on the Site the Review that complies with the General Review Conditions.
10. Each Review complying with the General Review Conditions will be published identically without any modification (syntactic, spelling etc.) being made by HerbalGem.
The Review will be posted on the corresponding product page and will include the following information:
- The publication date of the Review and any updates;
- The User's experience and its date;
- The rating assigned by the User according to the corresponding classification criteria;
- The first name or initials used.
The Review will be accessible for the entire duration of the marketing of the product concerned on the Site and will therefore be deleted by HerbalGem when the product concerned is no longer marketed by HerbalGem. In addition, HerbalGem reserves any eventual deletion of a Review in accordance with the General Review Conditions.
11. HerbalGem uses objective criteria to offer Users a Review sorting feature on the Site, including the publication date of the Review and the rating assigned to the product.
To refine their searches, Users of the Site have the option to filter Reviews by selecting one or more criteria.
12. By accepting the General Review Conditions, Users authorize, free of charge, worldwide, HerbalGem to freely adapt, publish, reproduce, translate, represent the Reviews, in whole or in part, on any tangible (paper, press, flyers, brochures, POS, posters etc.) or intangible (audiovisual, Internet, digital, computer, social networks etc.) medium, known or unknown, by any means and for any paid or unpaid purpose (marketing, promotional, internal/external communication etc.), for a period of 10 years.
13. Users are reminded to read our personal data protection policy which details the collection, processing, and management of personal data carried out by HerbalGem.
